1. About these terms

These terms apply to your use of gbscochin.com and to the services provided by GBS Cochin Consultancy Services Pvt. Ltd. ("GBS Cochin", "we", "us"), Room No. 6, First Floor, B & B Building, Power House Road, Palarivattom, Kochi, Kerala 682025. By using our website or engaging our services, you agree to these terms. If we agree different terms with you in writing for a particular engagement, those terms take priority for that engagement.

We provide consultancy and filing assistance for licences, registrations, returns and related compliance, including FSSAI licensing, GST, income tax, company registration, trademark, ISO certification and other registrations described on our website. The exact scope of each engagement is what we agree with you when you instruct us.

Some specialised services may involve professionals or bodies we work with, such as chartered accountants, company secretaries or ISO certification bodies. Where applicable, we remain your point of contact for coordinating those services.

4. Approvals and timelines

Government authorities decide whether to grant, return or reject an application, and how long processing takes. We prepare and file applications with care, but we cannot guarantee approval, a specific outcome or a specific timeline. Any time estimates we give are based on our experience and are not commitments. Authorities may raise queries, ask for inspections or request additional documents. We will help you respond to these within the scope of the engagement.

5. Your responsibilities

• Give us complete, accurate and genuine information and documents. You remain responsible for the truth and accuracy of information filed in your name.
• Respond to our requests for documents, corrections and approvals on time. Delays on your side can delay or end an application.
• Tell us promptly about changes that affect your licence or registration, such as a new address, product, manufacturer or turnover.
• Keep up with the ongoing obligations attached to your licences and registrations, such as annual returns or periodic filings, unless you have engaged us to handle them.

6. Fees, payment and refunds

• Our service charge and the government fee are separate. We explain both before work begins. Some government fees can only be confirmed once the relevant department calculates them during processing.
• The service charge is generally payable in advance, unless we agree otherwise in writing.
• Full payment, including any balance of the service charge and applicable government fee, must be made before we deliver the final certificate, licence or registration.
• Government fees are paid to the relevant authority and are subject to that authority's rules, including its applicable refund rules. Where a government fee is refundable by the authority, we will assist with the refund process where applicable.
• Requests for a refund of the service charge are considered case by case, taking into account the work already completed and any costs incurred. Please contact us in writing with your request.

7. Accounts and records in your name

Government portal accounts created for your applications are created in your name and belong to you. On request, we will share the login details and other account information that we hold and are permitted to provide for those accounts, together with copies of documents and certificates relating to your work, subject to any applicable restrictions imposed by the relevant authority or portal.

8. Confidentiality and privacy

We treat your documents and business information as confidential and use them for the purpose of providing our services, except where disclosure is required by law, by a government authority, or is reasonably necessary to complete the services you have engaged us to provide. Our articles, guides and service pages are general information to help you understand compliance requirements. They are not legal, tax or professional advice for your specific situation. Rules and procedures can change, and while we try to keep our content current, it may not reflect the latest requirements at all times. 11. Limitation of liability

To the extent permitted by applicable law, GBS Cochin will not be liable for losses caused by decisions, actions, omissions or delays of government authorities, by incorrect, incomplete or misleading information provided by you, or by events outside our reasonable control.

To the extent permitted by applicable law, our total aggregate liability arising from any particular engagement will not exceed the service charge actually paid to us for that engagement. Nothing in these terms limits or excludes liability or rights that cannot lawfully be limited or excluded under Indian law.

12. Ending an engagement

You may end an engagement at any time by telling us in writing. We may decline or stop work if information provided is false or misleading, if payments are not made, if you fail to provide information or documents reasonably required to complete the engagement, or if continuing would breach applicable law. Section 6 applies to fees and refunds following cancellation or termination.

13. Governing law and jurisdiction

These terms are governed by the laws of India. Subject to any mandatory jurisdiction available under applicable law, courts having jurisdiction in Ernakulam, Kerala, shall have jurisdiction over disputes arising from these terms or the services provided by GBS Cochin.

14. Changes to these terms

We may update these terms from time to time. The version published on this page at the time you engage us will generally apply to that engagement, unless a different version is agreed with you in writing or applicable law requires otherwise.

15. Grievances and complaints

If you have a complaint or grievance concerning our services, billing, delivery, documentation or any other aspect of your engagement with GBS Cochin, please contact us using the details below. We will review the complaint and respond within a reasonable period having regard to the nature of the complaint and applicable law.

16. Severability

If any part of these terms is found to be invalid or unenforceable, the remaining parts will continue to apply.
